The website KiWi-Maps.com is a tool to help diagnose polluted sites and soils. The format is an online software.

The customer declares to have read and accepted the general conditions of use prior to the use of the site.

The connection on the site KiWi-Maps.com is therefore valid for acceptance of the general conditions of use.

ARTICLE 3 : Definitions

The purpose of this clause is to define the various essential terms of the contract :

User : this term refers to anyone who uses the site or any of the services offered by the site.

Member : the User becomes a member when identified on the site.

Guest : a member or non-member who has received a project share link from a member user.

Login and password : it is all the information necessary to identify a User on the site. The username and password allow the User to access services reserved for members of the site. Password is confidential.

ARTICLE 4 : Compatibility of web browsers

The website KiWi-Maps.com is developed and tested on the Chrome browser (current version).

We regularly check the compatibilities on Firefox, Safari and Edge.

KiWi-Maps.com can not guarantee that all features are compatible with your browser.

ARTICLE 5 : Availability of your personal space

Your access to KiWi-Maps.com is guaranteed if you have a valid subscription.

In case of non-renewal or non-payment, without any indication from you, your personal space will be kept for six months and may be reactivated in case of renewal of a subscription.

After this time your data will be erased permanently. KiWi-Maps.com can not be held responsible for the loss of this data.

ARTICLE 6 : Order

You can order our products directly on our website or by email : contact@kiwi-maps.com.

You will receive an e-mail confirming your order on the e-mail address you indicated when placing your order.

ARTICLE 7 : Activating your account

Activation of the User account will only take place after payment of your order.

Or after checking your details in the case of a free trial version.

Account activation time is up to two business days.

ARTICLE 8 : Payment terms

We accept payments only by bank transfer. On you transfer details, indicate the invoice reference.

ARTICLE 9 : Right to retract

In accordance with Article L121-20 of the French Consumer Code, you have a right of withdrawal to exercise within seven working days from the activation of your user account. You have neither to justify reasons nor to pay penalties.

ARTICLE 10 : Conditions and repayment terms

The refund of the products is integral. It is made by bank transfer as soon as possible and at the latest within 30 days from the date of exercise of the right of withdrawal.

Article 11 : User Termination

You can terminate a user account at any time

At the end of a trial version, without any other indication from you, the termination will be automatically.

The trademarks, logos, signs and other content of the site are protected by the Code of intellectual property and more particularly by copyright.

The User assumes the risks associated with the use of his username and password. The site declines all responsibility.

Any content posted by the User is his sole responsibility. The User agrees not to put on line content that may affect the interests of third parties. Any legal action taken by an injured third party against the site will be supported by the User.

The results and simulations of KiWi-Maps.com are provided for information only and requires interpretation by the User. KiWi-Maps.com can not be held responsible for the use of these data.

Any use of the service by the User directly or indirectly resulting in damages must be compensated for the benefit of the site.

The site is committed to implementing all necessary means to ensure the best security and confidentiality of data.

The responsibility of the site can not be committed in case of force majeure or the unpredictable and insurmountable fact of a third.

ARTICLE 16 : Project Sharing by the User

The website KiWi-Maps.com allows members to share projects with guests.

When the User gives access to his project to a guest via the Site Sharing feature, he is the only person responsible for respecting the confidentiality of his project.

The User can at any time delete the sharing of a site in the sharing tab.

In his invitation message sent by the email address invitation@kiwi-maps.com, the user is solely responsible for the content of his personalised message.

ARTICLE 17 : Jurisdiction and applicable law

In the event of a dispute between the consumer customer and EvalDépol, the applicable law is French law.

The French courts have sole jurisdiction to settle the dispute.
